Near u מופעלת על ידי בועז גולן ניהול והפקות בע"מ, ח"פ 516772696, הרצל 27, קריית אתא 2808841 ("אנחנו"). יצירת חשבון או שימוש באפליקציה מהווים הסכמה לתנאים האלה ולמדיניות הפרטיות. מי שלא מסכים/ה - אל תשתמשו ב-Near u.
1. השירות
Near u מאפשרת למבוגרים לראות משתמשים אחרים שנמצאים בסביבה, לצפות בפרופיל קצר שלהם ולתקשר איתם בצ'אט, בתמונות, בהודעות קוליות, בסרטונים ובשיחות וידאו. Near u היא אפליקציה חברתית ואינה שירות היכרויות, ליווי או שידוכים.
2. מי יכול להשתמש
רק בני 18 ומעלה שכשירים להסכים לתנאים. חשבון אחד לכל אדם, עם מספר טלפון ששייך לך.
3. החשבון שלך
שמרו על המכשיר ועל קודי האימות. האחריות לפעילות בחשבון היא שלך. אפשר להתנתק מכל המכשירים ולמחוק את החשבון בכל רגע (פרופיל > מחיקת חשבון, או בדף מחיקת חשבון).
4. אפס סובלנות לתוכן פוגעני ולמשתמשים פוגעניים
אסור לפרסם, לשלוח או לעשות את הדברים הבאים. הפרה תוביל להסרת תוכן ולהשעיה או חסימה לצמיתות, בלי הודעה מוקדמת:
- עירום, תוכן מיני או הצעות מיניות; כל תוכן שמעורבים בו קטינים
- הטרדה, בריונות, איומים, מעקב או הגעה אל אדם בניגוד לרצונו
- תוכן שנאה או פגיעה באנשים בגלל גזע, מוצא, דת, לאום, מגדר, נטייה מינית, מוגבלות וכדומה
- אלימות, נשק, סמים, הונאה, ספאם, פרסום או בקשת כסף
- התחזות, פרופיל מזויף או שימוש בתמונה של מישהו אחר
- שיתוף מידע פרטי של אדם אחר (כולל מיקום) בלי הסכמתו
- הקלטת שיחות או הודעות של אחרים בלי הסכמה, כשהדין מחייב הסכמה
- שימוש בבוטים, איסוף מידע אוטומטי, או ניסיון לגלות את המיקום המדויק של משתמש/ת אחר/ת
5. דיווח, חסימה ופיקוח
אפשר לחסום כל משתמש/ת, להסתתר ממנו/ה ולדווח מתוך האפליקציה. אנחנו בודקים דיווחים תוך 24 שעות, מסירים תוכן פוגעני ומרחיקים את מי שפרסם אותו. כשמוגש דיווח, צוות הפיקוח רשאי לעיין בהודעות שבין המדווח/ת למשתמש/ת שדווח/ה. אנחנו משתמשים גם בסינון אוטומטי של מילים פוגעניות. יצירת קשר: nearu@nearu.co.il.
6. בטיחות במפגשים
היפגשו במקום ציבורי, ספרו לחבר/ה לאן אתם הולכים וסמכו על האינטואיציה. איננו עורכים בדיקות רקע ואיננו אחראים להתנהגות משתמשים ברשת או מחוצה לה. בחירום התקשרו למשטרה - 100.
7. התוכן שלך
התוכן שלך נשאר שלך. את/ה מעניק/ה לנו רישיון מוגבל, לא בלעדי, לאחסן ולהציג אותו רק לצורך הפעלת השירות, ומאשר/ת שיש לך זכויות בכל מה שהעלית.
8. מיקום ויצירת קשר
תכונות הסביבה דורשות גישה למיקום. אחרים רואים רק טווח מרחק משוער וכיוון כללי, לא את המיקום שלך במפה. טשטוש המיקום מופעל כברירת מחדל. אפשר להסתתר מאנשים מסוימים או לעבור למצב בלתי נראה. כדי למנוע הטרדה, אפשר לפנות רק למשתמשים שנראים כרגע בסביבה, לשיחות קיימות ולחברים, ויש מגבלות קצב על הודעות.
9. זמינות ושינויים
השירות ניתן כפי שהוא (AS IS), יכול להשתנות ולהיקטע. אנחנו רשאים לעדכן את התנאים ונודיע באפליקציה לפני שינוי מהותי.
10. הגבלת אחריות
ככל שהדין מתיר, איננו אחראים לנזק עקיף או תוצאתי או למעשים של משתמשים אחרים. אין בתנאים כדי להגביל אחריות שאי אפשר להגביל לפי דין.
11. סיום
אנחנו רשאים להשעות או לסגור חשבון שמפר את התנאים. אפשר להפסיק להשתמש ולמחוק את החשבון בכל רגע.
12. דין ושיפוט
על התנאים חלים דיני מדינת ישראל, וסמכות השיפוט נתונה לבתי המשפט המוסמכים בישראל, בכפוף לזכויות צרכניות מחייבות במדינה שלך.
13. תנאים לגבי Apple
התנאים הם בינך לבינינו, לא בינך לבין Apple. ל-Apple אין חובה לספק תמיכה או תחזוקה, היא אינה אחראית לטענות הקשורות לאפליקציה, והיא מוטבת צד שלישי של התנאים, שרשאית לאכוף אותם.

Near u is operated by BOAZ GOLAN MANAGEMENT AND PRODUCTIONS LTD (company no. 516772696), 27 Herzl, Kiryat Ata 2808841, Israel ("we"). By creating an account or using the app you agree to these Terms and to the Privacy Policy. If you do not agree, do not use Near u.
1. The service
Near u lets adults see other users who are nearby, view their short profiles and communicate with them by chat, photos, voice messages, videos and video calls. Near u is a social app; it is not a dating, escort or matchmaking service.
2. Eligibility
You must be at least 18 years old and legally able to accept these Terms. One account per person, with a mobile number you own.
3. Your account
Keep your device and verification codes secure. You are responsible for activity on your account. You can log out of all devices and delete your account at any time (Profile > Delete account, or the account deletion page).
4. Zero tolerance for objectionable content and abusive users
You must not post, send or do any of the following. Violations lead to removal of content and suspension or permanent ban, without notice:
- Nudity, sexual content or sexual solicitation; any content involving minors
- Harassment, bullying, threats, stalking, or following someone in person against their wishes
- Hate speech or attacks on people based on race, ethnicity, religion, nationality, gender, sexual orientation, disability or similar
- Violence, weapons, illegal drugs, fraud, scams, spam, advertising or requests for money
- Impersonation, fake profiles, or using someone else's photo
- Sharing another person's private information (including location) without consent
- Recording others' calls or messages without consent where the law requires it
- Bots, scraping, or trying to determine another user's exact location
5. Reporting, blocking and moderation
You can block or hide from any user and report them from within the app. We review reports within 24 hours, remove objectionable content and eject users who post it. When a report is filed, moderators may review the messages between the reporter and the reported user. We also use automated filtering of offensive words. Contact: nearu@nearu.co.il.
6. Safety when meeting people
Meet in public places, tell a friend where you are going and trust your instincts. We do not run background checks and are not responsible for users' conduct online or offline. In an emergency call local emergency services (Israel police: 100).
7. Your content
You keep ownership of what you post. You give us a limited, non-exclusive licence to host and display it only to operate the service, and you confirm you have the rights to anything you upload.
8. Location and contact
Nearby features require location access. Others see only an approximate distance range and a rough direction, never your position on a map. Location blur is ON by default. You can hide from specific people or go invisible. To prevent harassment, you can only start contact with users currently visible nearby, existing conversations and friends, and messages are rate-limited.
9. Availability and changes
The service is provided "as is", may change and may be interrupted. We may update these Terms and will notify you in the app before material changes take effect.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages or for the acts of other users. Nothing limits liability that cannot be limited by law.
11. Termination
We may suspend or close accounts that violate these Terms. You may stop using the service and delete your account at any time.
12. Law
These Terms are governed by the laws of the State of Israel and the competent courts in Israel have jurisdiction, subject to mandatory consumer rights in your country.
13. Apple-specific terms
These Terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance, is not responsible for claims relating to the app, and is a third-party beneficiary of these Terms entitled to enforce them.
